HIPAA Compliance

Summary Plan Descriptions
ERISA requires almost every employee benefit plan to have a summary plan description (SPD) and to furnish copies to each individual entitled to the benefit. The Department of Labor indicates that the SPD is the primary vehicle that informs the participants and their dependents about their benefits, as well as their rights, under the employee benefit plan.
Many insurance companies only provide a benefit description, not the required summary plan description. The summary plan description is the responsibility of the employee benefit plan.
